These terms govern your use of Engine Sound, the web service at teslav8.com that plays synthesized engine sounds in a car's web browser (the "Service"). The Service is operated by Engine Sound, based in Armenia ("Engine Sound", "we", "us"). By using the Service you agree to these terms. If you do not agree, do not use the Service.
Engine Sound is an independent product. It is not affiliated with, endorsed by or sponsored by Tesla, Inc. or any other car maker. "Tesla" and the names of the cars whose sounds the Service imitates (for example Ferrari, Lamborghini, Mercedes-AMG, Porsche) are trademarks of their owners and are used only to describe the kind of sound being imitated and the cars the Service works in.
The Service is for entertainment. It generates engine sounds in your browser from your device's location and speed or from on-screen controls. It does not read any data from your vehicle and does not control or change any vehicle function. It does not replace any sound a vehicle is required by law to make.
Speed, RPM, gear, 0–100 times and every other figure shown are estimates made from your device's GPS and a simulation. They may be delayed or wrong. The Service is not a speedometer and must not be used to judge your speed, for navigation, or for any safety, legal or diagnostic purpose.
Keep your attention on the road and obey all traffic laws. Do not look at or operate the screen while driving; set it up while parked, or let a passenger do it (the passenger remote exists for this). Engine sounds can mask sirens, horns and other warnings: use a volume at which you can always hear your surroundings, emergency vehicles and your car's own alerts. The 0–100 timer is for closed courses only, never public roads.
You alone are responsible for how you drive and how you use the Service. Engine Sound accepts no responsibility for any accident, injury, death, damage, loss, fine, penalty or legal consequence of any kind arising while or after using the Service, including any caused by distraction, volume, wrong or delayed figures, or a failure of the Service.
The engines, sounds, dials, names and pictures in the Service are not fixed. We may add, rename, change or remove any of them at any time, for any reason, including when a car maker or other rights holder asks us to or when the law requires it. Where a sound has to go we may replace it with a similar one under a general name (such as "Italian V12"), but we do not promise to. Pro gives access to the content available at the time, not to any particular car, sound or name. Such changes do not entitle you to a refund.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Prices are shown before tax; any sales tax or VAT due in your country is added at checkout.
Subscriptions renew automatically at the end of each period until cancelled. You can cancel at any time; Pro then stays active until the end of the period you have paid for, and you will not be charged again. We may change prices for future periods; a new price applies only from your next renewal after we tell you. Payments are non-refundable except where the law requires otherwise; see the Refund Policy.
A Pro subscription is for one car's browser at a time. You may move it to another car with the email used at purchase; to prevent misuse, a subscription can be moved at most twice in 30 days. Sharing, reselling or circumventing these limits is not allowed.
Pro users may share an invite code that gives another car one day of Pro; when that car buys Pro, the inviter receives one week of Pro free. Free tries and invite rewards have no cash value and may be changed or ended at any time.
The Service, including its code, sound designs and recordings, dials, graphics, texts and name, belongs to Engine Sound and is protected by copyright and other laws. You get a limited, personal, non-exclusive, non-transferable licence to use it for your own non-commercial use. You may not copy, download, record for redistribution, reverse engineer, decompile, scrape or extract any part of it, resell or sublicense it, or use it to build a similar or competing product. You may not get around the measures that protect it, such as Pro access, encryption or rate limits, or access it by bots or other automated means. We may act against any such use, including by notices to hosting providers and stores.
Do not attempt to break, overload or gain unauthorised access to the Service or other users' data, and do not use it unlawfully. We may suspend or end access, including Pro, for anyone who breaks these terms, without refund.
Whether the Service works in a given car depends on its model, software version and browser, on your device and on GPS reception, all of which are outside our control. A car or browser update may stop the Service working, fully or in part. We may change, suspend or stop the Service, or any part of it, at any time.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and uninterrupted or error-free operation.
To the maximum extent permitted by law, Engine Sound is not liable for any damages of any kind, whether direct, indirect, incidental, special, consequential or punitive, including personal injury, property or vehicle damage, loss of data, profits or use, fines or penalties, however caused and whatever the legal theory, even if we were told they were possible. Where liability cannot be excluded, our total liability is limited to the amount you paid for the Service in the 3 months before the claim. Some countries do not allow certain limits; in those countries our liability is limited to the smallest extent the law allows.
You agree to defend and hold harmless Engine Sound from any claim, loss, damage or cost (including reasonable legal fees) arising from your use of the Service, your driving, or your breach of these terms or of any law.
We may update these terms. We will post the new terms on this page with a new date; continuing to use the Service after a change means you accept it.
These terms are governed by the laws of the Republic of Armenia, and any dispute shall be settled by the courts of Yerevan, Armenia, except where the mandatory consumer protection rules of your country of residence give you a right that cannot be waived. If any part of these terms is found unenforceable, the rest stays in force.
